How to write a resignation letter

  1. 1

    Date and details

Put the date, your name, your job title and the name of the person you report to or the HR officer.

  2. 2

Say clearly that you are resigning

One sentence: "I wish to resign from my position as [Job title] at [Employer]."

  3. 3

    Give your last day

Count the notice your contract or the law requires, and write the date.

  4. 4

Say thank you, only if it is true

One sentence about the job or the people is enough. You do not need a long explanation or a reason.

  5. 5

Offer a handover, only if you will do it

For example, "I will hand over my work to [name] before my last day."

  6. 6

    Sign and keep a copy

Ask the receiver to sign or reply to confirm they got it, and keep that proof.

Mistakes to avoid

  • Writing when you are angry

The letter may be read later, in a reference check or a dispute.

  • Leaving out the date or your last working day

Without a date, nobody can tell when your notice starts or ends.

  • Resigning only on WhatsApp with no reply

Ask for a written confirmation that your employer received it.

  • Walking out without reading your contract

It may ask for longer notice than the law does.

  • Saying things that are not true

Do not give a reason you do not have.

  • Forgetting to keep a copy

Keep the letter and the proof that it was received.

Notice period in Kenya

This is general information from the Employment Act, 2007. It is not legal advice.

  • Section 35 asks for notice in writing. It does not mention giving a reason.
  • Daily wages: either side can end the contract at the close of any day without notice.
  • Wages paid at intervals of less than one month (for example weekly): the contract ends at the end of the pay period after written notice is given.
  • Wages or salary paid monthly or at longer intervals: the contract ends 28 days after written notice is given.
  • If your contract asks for longer notice, the contract applies (section 35(2)).
  • Pay instead of notice: in the case of monthly pay, either side may end the contract without notice by paying the pay for the notice period (section 36).
  • Some employees are excluded in section 35(6), for example members of certain pension, provident fund or gratuity schemes and the NSSF. If you are not sure whether section 35 applies to you, ask your HR officer or a labour officer.

Questions and answers

Do I have to give a reason?

Section 35 asks for notice in writing and does not mention a reason. You can keep the letter short. Only write a reason that is true.

How much notice must I give?

It depends on how you are paid and on your contract. See the notice section above. If your contract says more, follow the contract.

Can I resign by email?

Many employers accept it, but check your contract and ask HR to confirm in writing that they received it. Keep a copy.

Can I leave without notice?

Only in the cases the law allows. Otherwise, check your contract and section 36 first. This page is not legal advice.

Who do I give the letter to?

Your line manager and the HR officer. Keep a signed copy.

What if my employer refuses to accept it?

Send it by email as well and keep proof. Ask a labour officer if you need help.

Should I update my CV now?

Yes, before your last day, while you remember your recent work in detail.
